ArkProject is an NFT developer platform developed and made available by Screenshot Labs (“Screenshot Labs,” “we,” “our,” “ours,” and “us”), a French corporation established at 7 place de l'Hotel de Ville, 93600 Aulnay-sous-bois, FRANCE.
This platform consists of multiple components that can be accessed through our website located at https://www.arkproject.dev/including the ArkProject API (a hosted Application Programming Interface for building NFT applications), the ArkProjectKit (a developer toolkit), and the ArkProject Protocol (an open-source NFT liquidity aggregation protocol). The ArkProject Protocol is comprised of open-source software, which is publicly available and located at https://github.com/ArkProjectNFTs.
These Terms of Use (the “Terms,”) govern your relationship with Screenshot Labs and your use of any services, tools, or information made available by us through (a) the ArkProject website operated by us and located at https://www.arkproject.dev/, (b) the ArkProject API, and (c) the ArkProject Kit (collectively, the “Services”).
Please read these Terms and our Privacy Policy located at https://www.arkproject.dev/privacy carefully. By using any of the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree completely to these Terms or our Privacy Policy, do not use the Services. By using the ArkProject website, you accept these Terms.
You are advised to check these Terms periodically as they may be updated. Changes will take effect immediately from posting of the revised documentation on the ArkProject website. You agree that continued use of the ArkProject website shall constitute acceptance of such amendments.

As part of the ArkProject website (https://www.arkproject.dev) we provide access to a suite of developer tools that grants access to NFT-related data on the Starknet blockchain ecosystem (the “Tools”).
Access to the ArkProject website is provided on a “as is” and “as available” basis only. We do not guarantee that the ArkProject website, or any content on it, will always be available or uninterrupted. From time to time, access may be interrupted, suspended or restricted, including because of a fault, error or unforeseen circumstances or because we are carrying out planned maintenance.
We may suspend or disable your access to the ArkProject website if we consider it reasonable to do so, e.g. you breach these Terms.
We may remove or amend the content of the ArkProject website at any time. However, some of the content may be out of date at any given time and we are under no obligation to update it. We do not guarantee that the ArkProject website, or any content on it, will be free from errors or omissions.
You will comply with all applicable domestic and international laws, statutes, ordinances and regulations applicable to your use of the ArkProject website.
To access the Services and Tools on the ArkProject website including the ArkProject API and the creation of an ArkChain marketplace, you will need to create an account on the ArkProject website.
You agree to access and use the ArkProject website only for its intended purpose and will not attempt to:
1) Hack, make unauthorized alterations to, gain unauthorized access to, or introduce any kind of malicious code to the ArkProject website by any means;
2) Reverse engineer or decompile (whether in whole or in part) any software available through the ArkProject website;
3) Make copies, modify, reproduce, transmit, alter or distribute all or any part of the ArkProject website or any material or information contained in it;
4) Use the ArkProject website for any purpose that is unlawful;
5) Use the ArkProject website in any manner that disrupts its operation;
6) Disguise or interfere in any way with the IP address of the computer you are using to access the ArkProject website or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing the ArkProject website.
You acknowledge that the ArkProject website and your use of the Services and Tools contain certain risks, including without limitation the risks that the Services may be suspended or terminated for any or no reason. Accordingly, you expressly agree that you assume all risk in connection with your access and use of the Services and Tools.

We are the owner of all intellectual property rights in the ArkProject website and its associated products, with the exception of the ones listed below. These works are protected by copyright laws and all such rights are reserved. We grant you a worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to use the products accessible on the ArkProject website for any commercial or non commercial purpose. This license includes the right to include the products into your own products or creations. This license however does not include the right to grant a sub-license on the products to third parties.
You agree not to monitor, use or copy our web pages without our prior consent. Any unauthorized use or reproduction may be prosecuted.
It is also specified that the Services and Tools, including the ArkChain Indexer & the ArkProject Order Book are Open Source Services, subject to the Apache License, version 2.0. You agree to comply with this licence in your use of the Services: https://www.apache.org/licenses/LICENSE-2.0
We do not guarantee that the ArkProject website, Services or Tools will be secure or free from bugs or viruses. The Tools are provided as is, and you are responsible for checking their security and performance before implementing them.
You are responsible for configuring your information technology, computer programs and platform in order to access the Services and Tools. You should use your own virus protection software.
You are responsible to ensure that your use of the Services and Tools, or any content taken from the ArkProject website, will not infringe the rights of any third party and/or comply with the applicable license.
We may perform any of our obligations, and exercise any of the rights granted to us under these Terms, through a third-party. We may assign any or all our rights and obligations under these Terms to any third-party.
If any of the provisions in these Terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the remainder shall continue in full force and effect.
All disclaimers, indemnities and exclusions in these Terms shall survive termination of the Terms and shall continue to apply during any suspension or any period during which the Services are not available for you to use for any reason whatsoever.
These Terms and the documents referred to in them set out the entire agreement between you and us with respect to your use of the Services and supersede any and all prior or contemporaneous representations, communications or agreements (written or oral) made between you or us.
The applicable law shall be French law. Any dispute, controversy, or claim arising out of or in relation to these Terms, including the validity, invalidity, breach or termination thereof, shall be submitted to the competent Court of Paris (France), except if otherwise provided by applicable law.
